These Terms of Service ("Terms") govern your use of the Golden Hours mobile application, website, and related services (collectively, the "Services") operated by Golden Hours LLC ("Golden Hours," "we," "our," or "us"). By downloading, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
⚠️ You must be 21 years of age or older to use Golden Hours. Golden Hours is a platform for discovering alcoholic beverage promotions and nightlife venues. By creating an account or using the Services, you represent and warrant that you are at least 21 years old. We reserve the right to terminate any account where age misrepresentation is discovered.
We collect date of birth during account registration solely to verify age eligibility. Users who misrepresent their age violate these Terms and applicable law. Golden Hours is not responsible for any harm resulting from underage use of the Services if age was misrepresented at registration.

Golden Hours reserves the right to refuse registration, suspend, or terminate any account at our sole discretion, including for violation of these Terms.

Golden Hours aggregates happy hour information from venue partners and publicly available sources. While we strive for accuracy, we do not guarantee that any venue information — including hours, specials, pricing, or availability — is current or correct at any given time.
Golden Hours is not responsible for any decision made in reliance on venue information displayed in the app. We recommend confirming details directly with the venue before visiting. Venues are responsible for notifying us of changes to their information by contacting venues@goldenhours.app.
By submitting a venue through the Golden Hours website or venue portal, the venue owner or authorized representative agrees to the following:

Golden Hours offers an in-app bottle service reservation and payment feature for select nightlife venues. By using this feature, you agree to the following:
Golden Hours operates a rewards program that awards points for check-ins at participating venues.
If you submit any content to Golden Hours — including profile photos or communications — you grant Golden Hours a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content solely for the purpose of operating and improving the Services. You represent that you have the right to submit any content you provide and that it does not violate any third-party rights.
All content, design, graphics, logos, text, software, and other materials within the Golden Hours app and website are the exclusive property of Golden Hours LLC or its licensors and are protected by United States copyright, trademark, and other intellectual property laws.
The Golden Hours name, ◈ logo, "GOLDEN HOURS" wordmark, and all associated branding are trademarks of Golden Hours LLC. You may not use any Golden Hours trademark, logo, or branding without our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Golden Hours app for your personal, non-commercial use only. This license does not include the right to:
Golden Hours integrates with or links to third-party services including Resy, OpenTable, Instagram, Apple Maps, Stripe, and Supabase. Your use of any third-party service is governed by that service's own terms and privacy policy. Golden Hours is not responsible for the content, practices, or availability of any third-party service.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. GOLDEN HOURS DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
GOLDEN HOURS DOES NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOLDEN HOURS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICES, INCLUDING BUT NOT LIMITED TO:
IN NO EVENT SHALL GOLDEN HOURS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO GOLDEN HOURS IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Golden Hours LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Services.
Golden Hours reserves the right to suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or extended inactivity.
Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and governing law — will survive.
We may update these Terms at any time. When we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising from these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
Before initiating any formal legal proceeding, you agree to contact Golden Hours at support@goldenhours.app and attempt to resolve the dispute informally. If the dispute is not resolved within 30 days, either party may pursue legal remedies.
